Course description for academic year 2020/2021

Contents and structure

The course has three main parts: civil procedure, appraisement procedure and land consolidation. Students will learn about the structure of the judicial system and how it operates, with an emphasis on civil disputes and conflict resolution. The course provides a thorough examination of civil procedure, appraisement and land consolidation. This includes a detailed treatment of basic procedural principles, the organisation of the courts, the rights and responsibilities of the parties, the character and administration of the lawsuit, various forms of mediation, the law of evidence, the appeals process (an overview) and the binding nature of court decisions. In addition, the course provides tutoring in the use of legal databases and training in critical analysis of case law.

Learning Outcome

Knowledge  

The candidate will gain:  

  • An in-depth and comprehensive understanding of civil procedure, appraisement procedure and land consolidation procedure.  
  • A thorough knowledge of the judicial system and how courts function, both in relation to civil disputes, appraisement and land consolidation.  
  • An advanced understanding of legal method.   

Skills  

The candidate will be able to:  

  • Solve advanced legal problems within civil procedure, appraisement procedure and land consolidation procedure.  
  • Explain thoroughly the legal theory behind civil procedure, appraisement procedure and land consolidation procedure.  
  • Use legal databases to address legal questions and critically assess case law. 

General competence 

The candidate will acquire:  

  • An overview of procedural rules pertaining to civil cases.
  • An ability to critically reflect on and analyse ethical issues related to appraisement proceedings.

Teaching methods

Most of the teaching will consist of lectures and training assignments. In addition, the students will be tutored in the use of legal databases.

Compulsory learning activities

Excursion (the students will attend civil court proceedings lasting at least one day).

Oral presentation of semester assignment, approved/not approved.

Approved obligatory course components remain valid for three consecutive semesters.

Assessment

Letter grades (A-F) based on the following components:

  • One individual semester assignment of up to 4000 words (40%).
  • Oral exam of 30 minutes (60%).

To repeat the exam, a new semester assignments and/or a new oral exam must be completed. Students may choose to redo only one of the components, retaining the grade from the other one.

Examination support material

For the oral exam, student may bring primary legislation and regulation, without comments or references to other sources.
